Sullivan (1964) was explicitly motivated by concern about defamation law's chilling effect on civil rights coverage: southern officials were using defamation suits against publications covering the civil rights movement to impose ruinous legal costs and suppress political reporting. Chilling effects operate outside formal law as well. When social media platforms enforce community standards aggressively and unpredictably, speakers may self-censor legitimate expression to avoid account suspension. When employers monitor employees' social media and punish disfavored speech, employees self-censor. When academic departments informally signal that certain topics are unwelcome, researchers may avoid those topics. These informal chilling effects are not legally cognizable but are real constraints on the marketplace of ideas that free speech theory depends on. The concept is important precisely because it reveals that the practical range of free expression is never simply what the law formally permits.
